1. Who we are
textbased.video is made by the operator of the registered Australian business name text based video (“we”, “us”). You can reach us at support@textbased.video.
2. Pre-release software
textbased.video is in alpha. Alpha and beta versions are early builds for testing. They may have bugs, lose work or change without notice, and we may withdraw them at any time. Please don't rely on them for work you can't afford to redo. Keep your original footage and back it up.
3. Your licence to use the software
We licence the software to you. We don't sell it. As long as you follow these terms, we give you a personal, non-exclusive, non-transferable licence that we can end as set out in section 11:
- The apps are free. You can install them on devices you own or control and use them for personal or work projects, including commercial work.
- The Premiere Pro extension needs a licence key. You can use it on as many computers as your licence allows (two, unless your licence says otherwise), for as long as the licence is valid. It checks your licence online from time to time and keeps working offline for a limited period between checks.
If you get a licence through a reseller, the reseller's terms of sale also apply to that purchase.
4. What you mustn't do
- Sell, rent, lend, sublicense or transfer the software or a licence key.
- Share a licence key beyond the computers your licence allows.
- Get around the licence checks, tamper with licence keys, or remove notices about who owns the software.
- Copy, change, decompile or reverse-engineer the software, except as far as the law allows you to anyway. For example, the Australian Copyright Act 1968 permits some of this to make other programs work with it or to fix errors.
- Use textbased.video to break the law or anyone's rights, or against the terms of other software you use it with, such as Adobe Premiere Pro.
5. Your content
Your footage, sound, pictures, transcripts and edits belong to you or whoever you work for. They're never uploaded to us: we don't receive them or claim any rights to them. You're responsible for having the rights to work with your content and to share it with the people you send it to.
Transcripts are produced automatically and may contain mistakes. Transcripts made in our apps are made on your device. Transcripts made in Premiere Pro are made by Adobe's Speech to Text, under Adobe's terms. Check them before you rely on them, especially for quotes.
6. Moving files and passwords
You move .tbv files between people yourself, using services you choose. We aren't responsible for those services or for files lost, delayed or exposed through them.
If you lock a file with a password, keep the password safe and share it separately from the file. We can't recover a lost password or open a locked file for you.
7. Other software and services
textbased.video works alongside software made by others, such as Adobe Premiere Pro and Adobe Media Encoder, and uses open-source components and speech models, some downloaded from Hugging Face on first use. Those are covered by their own licences and terms. We don't control them and can't promise they'll keep working with textbased.video.
8. Who owns textbased.video
We own textbased.video, including its software, design, file format specification and brand. Apart from the licence in section 3, these terms don't give you any rights in them. If you send us ideas or feedback, we may use them without owing you anything.
9. Australian Consumer Law and warranties
Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law, and similar laws elsewhere may give you rights too. Nothing in these terms takes those rights away.
Apart from those rights, textbased.video is provided “as is” and “as available”. We don't promise it will be error-free, uninterrupted or suitable for any particular purpose.
10. Limits on our liability
As far as the law allows:
- we aren't liable for indirect or consequential loss, or for lost profits, revenue, data, work or deadlines; and
- our total liability for anything to do with textbased.video is limited to what you paid us for it in the 12 months before the claim. For free software and alpha versions, that's nothing.
Where the Australian Consumer Law lets us limit our liability for failing a consumer guarantee, our liability is limited to supplying the software again or paying for it to be supplied again.
11. Ending these terms
You can stop using textbased.video at any time by uninstalling it. We may suspend or end your licence if you seriously break these terms, or end a free or alpha licence by giving notice. When the licence ends you must stop using the software. Sections 5 to 10 and 12 continue to apply after that.
12. Changes, law and disputes
We may update these terms as textbased.video changes. If a change matters, we'll update this page and email licence holders before it takes effect. Using textbased.video after that means you accept the new terms.
These terms are governed by the laws of Australia. If you have a problem, please email us first and we'll try to sort it out. If we can't, the courts of Australia can decide it.
